What is Section 75 the Consumer Credit Act?

Section 75 vs Chargeback: Which to Use First?

Even if your purchase qualifies for Section 75 protection, it can make sense to try chargeback first. Unlike Section 75, chargeback isn’t a legal right, but it’s often quicker and simpler.

MSE founder Martin Lewis advises that for clear-cut casesβ€”like a cancelled holiday or an online order that never arrivesβ€”customers should request a chargeback via their bank rather than Section 75 initially, as banks can usually recover funds from the seller’s bank more easily through this route.

He says: “Even if you actually have a credit card and qualify for Section 75, I wouldn’t ask for that at this stage. I would ask for aΒ chargeback.

“That’s because under the chargeback process, which is part of the Visa, Mastercard and Amex rules, your bank is asking for money back from the holiday firm’s bank, which your bank is unlikely to have an issue doing.”
